Since HIPAA the compliance date of the privacy rule involving HIPAA in April 2003, there has been over 309,475 HIPAA complaints (Office for Civil Rights, 2022). As you can see this isa big issue and there is pray to many privacy issues, and this is only reported ones. One ethical issue related to the use of EHRS that directly impact advanced registered nursing practice is that there is such quick access to all of a patient record within seconds sometimes it could be easy to go beyond the scope of what care you are involved in and look far back into the patient’s history which is actually a breech of HIPAA. This can be an ethical issue if it changes your outlook on a patient and how you provide care if you have a bias towards the history that you read or if for example you find out your patient was incarcerated. I know in my healthcare system there was in issue with nurses searching where patients live and showing other nurses which is a breach of the patient’s privacy and can technically put the patient in danger by sharing their private residence. A legal issue related to the use of EHRs is false documentation whether that be on purpose or on accident. EHR’s make documentation so much easier but also easy to click and accidently falsify health information which a legal issue. I talked about in my last discussion board post that one of the biggest measures I can implement in my own practice is by always being aware of my surroundings and locking my computer screen when I step away. This way no one can walk by in the hallway and catch a glimpse of the EHR. I will also be aware of my surroundings and not have conversations with patient health information when unauthorized individuals may here.

I strongly encourage that you do not wait until the very last minute to complete your assignments. Your assignments in weeks 4 and 5 require early planning as you would need to present a teaching plan and interview a community health provider. I advise you look at the requirements for these assignments at the beginning of the course and plan accordingly. I have posted the YouTube link that explains all the class assignments in detail. The Health Insurance Portability and Accountability Act addresses the privacy and security of protected health information (PHI), which is contained in a patient’s electronic health record (HIPAA). Administrative safeguards, physical safeguards, and technical safeguards are the three pillars of PHI security outlined by HIPAA. These three pillars are also referred to as the three healthcare security safeguard themes. These topics range from methods for locating computers to using firewall software to safeguard health information. One ethical issue of using the EHR is the issue of confidentiality. Autonomy is compromised when patient health data are linked or shared without their knowledge. Due to their lack of faith in the security of the system holding their data, patients may withhold information. As a result, their care might be jeopardized(Chivilgina et al., 2022). There is a chance that errors or theft will cause the health information of thousands of patients to become public. When patient lose faith in such systems the work of advanced registered nurses becomes harder because of lack of access of information.
A legal challenge associated with the use of EHR is the risk of medical malpractice claims. Theirs an increase in the risk of malpractice especially among healthcare providers when adopting this technology. Risk also increases when transitioning from one system to the other. Her includes more documentation and this can be beneficial of damaging to one’s case. In some instances, basic human errors can trigger malpractice suits.There are various limitations to the systems and if there is an error in the way clinical information is presented, it is also difficult to prove vendor accountability. The systems can also result in errors. Just like the over reliance on spell check systems, sometimes EHRs may result to small mistakes can turn to medical errors. One strategy that can be employed to protect privacy and confidentiality is data encryption. EHRs can make the transfer of patient data safer by encoding the information in a way that can only be decoded by authorized programs or users in possession of the access code, such as test results or diagnoses to patients via patient portals or medical histories to referrals.Encryption can also reduce losses in the event that your data is stolen (Li et al., 2022). When combined with a role-based access control, it can also make it possible to secure information within your office so that only employees with the necessary access can view the decrypted data.
