Background of the Problem and Problem Statement Background of the Problem The demand for organs has significantly risen worldwide in recent years, but the supply for the same remains significantly low. This has caused an organ shortage crisis, becoming a major public health concern because of the imbalance between supply and demand. Patients end up on long waiting lists because not many people are freely willing to donate their organs, especially because many jurisdictions have not commercialized organ donations. According to Bianchino (2020), many people die on a global scale every year as they wait on the transplant lists because the available organs do not match the existing demand. The fact that people are expected to donate organs voluntarily without expecting any compensation is not encouraging to many potential donors. People who are financially desperate in some jurisdictions opt to sell their organs in the black market, posing a significant risk to their lives and wellbeing because of the nature of the surgical procedures that take place outside the hospital setting, with donors and recipients not receiving proper care before and after the illegal transplant surgeries. According to research conducted by the World Health Organization (WHO), approximately 10,000 kidneys are illegally sold in the organ transplant black market across the globe every year, with organ trafficking accounting for a significant number of organ transplants that happen every year (Wagner-Carena, 2021). This demonstrates just how bad the crisis is and how urgent governments need to act to find ways to address the crisis before it gets out of hand. Legalizing the sale of organs could be just the solution the world needs for more lives to be saved. Sellers 3 and buyers in the illegal organ market are exploited, with those struggling financially being persuaded into risky operations with or without their say, as organs are sometimes removed forcefully and used for trade (Bianchino, 2020). It is important to recognize that one of the major reasons why the illegal organ market exists is that organ sales have not been legalized in many jurisdictions, causing desperate people to take risky measures to survive. People who are desperate for organs are targeted by black market sellers and buyers of organs, leading them to engage in illegal organ transactions to save their lives and the lives of their loved ones. As a result, they end up endangering their lives because of the risky procedures and lack of proper care they receive when organ transplants are done on the black market. For this reason, the black market for organs and illegal organ trafficking and transplant has started growing on an international scale, with most organs being obtained illegally either without the consent of the donors or through deceit, with a significant number of lives getting lost in the process. With no laws and regulations legalizing the buying and sale of organs in many jurisdictions, some people opt for the black market because of the long organ transplant waiting lists, which offer them fewer chances of getting organs, with some people dying before they get the organs, making it an acute public health crisis (Cantarovich, 2019). It is a health crisis affecting people across the globe. Illegal organ transactions in the black market exist because many countries have not established legislation that would help give people the freedom and safer ways to donate their organs and financially benefit from them. Many people seek the black market to sell their organs because it is illegal in many countries. Driven by their financial stress, they find money by selling their organs. If the government allowed the commercialization of organs to be legal, desperate people would be in safer hands when obtaining and giving organs for transplants rather 4 than going to the black market where they could end up dead because of poor care and sometimes having their organs removed without their consent when they fall victim to scams by illegal organ traffickers. According to Fukai (2019), the issues related to the illegal organ market continue to impede the progress towards saving lives as the number of deaths continues to increase worldwide because of organ shortage. As long as any jurisdictions still have not established policies to help address this crisis by finding ways to legalize it, people will continue suffering, and the illegal organ market will continue thriving as lives continue getting lost. The illicit trade for human organs is furthered by the development of new technologies, which most criminals on the dark web understand. They use technology to contact buyers and sellers of organs without the authorities noticing. While desperate patients use the dark web to get organs to increase their chances of getting a transplant instead of waiting on the long transplant lists, the criminals engaged in illegal transactions end up doing anything possible to get the organs to make money. This means they can resort to kidnapping and human trafficking to obtain organs from people and, in most cases, without their genuine consent. This means that the illicit trade in organs helps some criminals further other criminal activities influenced by the money they make from the illegal organ sales in which vulnerable people are tricked and exploited into giving up their organs, promoting the wrongful exchange of human organs. According to Ambagtsheer and Bugter (2022), the illegal organ trade is growing significantly on a global scale because it fulfils the demand for organs in healthcare that the legal structures in place for organ transplants have failed to achieve. This demonstrates that the law against the sale of human organs is doing more harm than good because there exists a black market that desperate people can explore to get what they need while risking their lives and the lives of others. However, access to organs from the black market is only achieved by the rich who have the financial means, while those financially 5 poor end up dying. The government should consider establishing financial incentives for organ donors to provide equal access to transplant organs for all people regardless of their financial status for this problem to be addressed. Problem Statement Background of the Problem The rising demand for organs for transplant has seen a significant rise in the organ sales in the black markets especially because many jurisdictions do not recognize the harvesting and selling of organs. With no laws and regulations legalizing the buying and sale of organs, some people opt for the black market because the long organ transplant waiting lists with less chances of getting organs with some people dying before they get the organs, making it an acute public health crisis (Cantarovich, 2019). Compensation for organ donors will be instrumental in helping address this public health crisis because it will encourage more people to donate and lead healthier lives, avoiding the risks that come with donating through the illegal organ markets because of financial desperation. Caplan and Rhodes (2022) argue that it is important to increase the supply of organs for transplant so that the demand can be met, and compensation would serve as a significant way through which the supply of transplant organs can be increased. The potential benefit of addressing the problem It is possible that setting legislation that allows the commercialization of transplant organs will help increase the availability of transplant organs in the organ transplant market and meet the existing demand for organs in healthcare. Establishing a government-regulated commercial market for organs could result in an increased willingness for people to donate their organs and reduce the shortage of organs. It could also help reduce the number of deaths occurring as a result of illegal organ trafficking and the sale of organs because of the availability of a regulated market for organ sales. If you find that your paragraphs have more than one main idea, separate your paragraphs so that each has only one main point. The idea behind a paragraph is to introduce an idea and expand upon it. If you veer off into a new topic, begin a new paragraph. E – Evidence or Examples Your main idea needs support, either in the form of evidence that buttresses your argument or examples that explain your idea. If you don’t have any evidence or examples to support your main idea, your idea may not be strong enough to warrant a complete paragraph. In this case, reevaluate your idea and see whether you even need to keep it in the paper. A – Analysis Analysis is the heart of academic writing. While your readers want to see evidence or examples of your idea, the real “meat” of your idea is your interpretation of your evidence or examples: how you break them apart, compare them to other ideas, use them to build a persuasive case, demonstrate their strengths or weaknesses, and so on. Analysis is especially important if your evidence (E) is a quote from another author. Always follow a quote with your analysis of the quote, demonstrating how that quote helps you to make your case. If you let a quote stand on its own, then the author of that quote will have a stronger voice in your paragraph (and maybe even your paper) than you will. L – Link Links help your reader to see how your paragraphs fit together. When you end a paragraph, try to link it to something else in your paper, such as your thesis or argument, the previous paragraph or main idea, or the following paragraph.
